Please read the following Terms & Conditions carefully before using the website Leflair.com ("Site") or opening a Lefliar account ("Account") so that you are aware of your legal rights and obligations (hereinafter referred to individually as "Leflair", collectively referred to as "we", "our"). The "Services" we provide or make available include (a) the Site, and (b) all information, linked pages, features, data, text, images, photographs, graphics, music, sounds, video, messages, tags, content, programming, software, application services (including, without limitation, any mobile application services) or other materials made available through the Site or its related services ("Content"). Any new features added to or augmenting the Services are also subject to these Terms & Conditions. These Terms & Conditions govern your use of Services provided by Leflair.

All information, links, features, data, text, images, charts, music, audio, video, messages, tags, content, programs, software, applications services (including but not limited to any mobile service application) or other materials available on the Site or services related to the Site (“Content”). Any new or added features to the Service are governed by these Terms & Conditions. These Terms & Conditions govern your use of the Services provided by Leflair.

BY USING SERVICES OR OPENING AN ACCOUNT, YOU GIVE YOUR IRREVOCABLE ACCEPTANCE OF AND CONSENT TO THE TERMS OF THIS AGREEMENT, INCLUDING THOSE ADDITIONAL TERMS AND CONDITIONS AND POLICIES REFERENCED HEREIN AND/OR LINKED HERETO.

IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE OUR SERVICES OR ACCESS THE SITE. IF YOU ARE THE PARENT OR LEGAL GUARDIAN OF A MINOR WHO IS CREATING AN ACCOUNT, YOU MUST ACCEPT THE TERMS OF THIS AGREEMENT ON THE MINOR'S BEHALF AND YOU WILL BE RESPONSIBLE FOR ALL USE OF THE ACCOUNT OR SERVICES USING SUCH ACCOUNT, WHETHER SUCH ACCOUNT IS CURRENTLY OPEN OR CREATED LATER.

ACCOUNT/SHARE INFORMATION - CONFIDENTIALITY

When you create an account on Leflair website, you will be responsible for

  • keeping your password confidential and use only your User ID and password when logging in
  • ensure that you log out from your account at the end of each session on the Site
  • immediately notify Leflair of any unauthorised use of your Account, User ID and/or password

You are fully responsible for all activities that occur under your User ID and Account even if such activities or uses were not committed by you. LEFLAIR will not be liable for any loss or damage arising from unauthorised use of your password or your failure to comply with this Section.

Leflair always guarantees the security of information and uses the best protection answers for payment methods. Individual information of clients in payment processes will be protected safely.

You should not utilize any devices or tools to try to interfere to change the data structure. All activities of distributing or encouraging to enter illegally or destroy our data will be strictly prohibited. Please do not use our website for wrong purposes. All infringement will be stripped of all rights or facing to be accused under the law for necessary.

All exchanged data will be secured and we will be compelled to give data to approved body if requested.

MEMBERSHIP - HOW IT WORKS?

Our services will be applied for members only and you have to be 18 years old or older to access. If you are underage, please get your parents acceptance to register or you'll be removed from our customers list. At least you have to be at legal age to decide to get any services. Membership is accessible when you join with us via your friend's invitations or you have to complete our form to get registration. When you finish all the steps of connecting with us, you can use our services. As a Member, you have to give us your exact information promptly to update to our registration form. Membership can access services without any prohibitions. Leflair members have the rights to use the website to make an order, ask for services, manage account or for other reasonable purposes. We also can stop providing you any services without notice if you have violations affect to our terms and conditions.

SELLER'S RESPONSIBILITIES

Seller shall properly manage and ensure that relevant information such as the price and the details of items, inventory amount and terms and conditions for sales is updated on Seller's listing and shall not post inaccurate or misleading information.

Seller shall issue receipts, credit card slips or tax invoices to Buyer on request.

RESPONSIBILITIES OF MEMBERS AND/OR BUYERS

Members and/or Buyers must read and accept all of the terms and conditions in, and linked to, these Terms & Conditions and you must consent to the processing of your personal data as described in the Privacy Policy linked hereto.

Members and/or Buyers agree not to:

  • Use the Services or upload Content to impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity
  • Use the Services for the benefit of any third party or any manner not permitted by the licenses granted herein
  • Open and/or operate multiple user accounts in connection with any conduct that violates either the letter or spirit of these Terms & Conditions
  • Attempt to decompile, reverse engineer, disassemble or hack the Services (or any portion thereof), or to defeat or overcome any encryption technology or security measures implemented by LEFLAIR with respect to the Services and/or data transmitted, processed or stored by LEFLAIR
  • Harvest or collect any information about or regarding other Account holders, including, without limitation, any personal data or information

SHIPPING & DELIVERY

Third parties logistics and time to delivery

We will ship as fast as possible based on the shipping option that you choose. Your order will be auto-confirmed by our system as soon as you placed the order. You will also be notified by email on the day of delivery when the package is out for delivery.

When completing all the steps of purchase, you'll receive our order confirmation email or SMS (Short Message Services) which provide order details. In case of any unexpected problems, we will contact you directly to inform you as soon as possible.

When you receive your parcel, you must check your product carefully before signing for acknowledgment. We encourage you to record a video when unboxing your parcel. If you cannot receive the parcel for any reason, please contact us to arrange another shipping address or change the time of delivery for your convenience.

If the shipment is delayed by any reason from you, we will inform you to cancel the order and refund all of your payment.

Case of late delivery

Leflair always estimates the date of shipping and delivery to our customers. However, we work with another third party as mentioned above so sometimes we will have some unforeseen circumstances affecting the schedule of delivery.

Please let us know if your order is not delivered on time. We will advise you of delivery exceptions for anticipated delays

Shipping fees

The shipping fee is calculated based on the product weight and dimensions, the value of the order, the shipping address and the Delivery option selected.

Packaging

Your parcel is carefully packed in accordance with our standard packaging requirements. Should you have any suggestions or additional packing requirements, you may have to pay additional fees.

WARRANTY

All products we offer are genuine, so the warranty policy depends on the manufacturer, whether the costs are borne by you or taken care of. This information is specified on each warranty card provided with the product you ordered. Note that if your product is out of warranty duration, you will be responsible for repairing cost (if any).

PAYMENTS

From time to time, Leflair supports one or more of the following payment methods:

(i) Cash on Delivery when the item is eligible

With Cash on Delivery, you can pay in cash to the delivery person upon reception of your parcel. This payment method is available nationwide and does not require any upfront payment or additional fee. Upon arrival of the delivery person, ensure you prepare the right amount in order to receive your parcel.

Please prepare the exact amount of your order to give the delivery staff to save time and make it convenient for you.

Duties charged upon delivery if paid by COD

If your International order contains (a) product(s) eligible for extra duties and your payment method is COD, you will need to pay the duty amount mentioned on your confirmation email, in cash, upon delivery of the product.

(ii) Visa / Mastercard cards / AMEX / JCB

Credit / debit cards are made via third-party payment channels and the list of accepted cards depends on the payment channel you are using.

For cards payment method, we will complete the transaction via another third party and make sure to keep all your card information in security.

Duties charged upon delivery if paid by Card

If your International order contains (a) product(s) eligible for duties and your payment method is debit/credit cards, there will be two payments required:

1) Product price by debit or credit card at checkout on the website

2) Duty amount mentioned on your confirmation email to be paid, in cash, upon delivery of the product.

It is not allowed to change the payment methods once the order is placed.

RETURNS, REFUNDS, CANCELLATIONS AND BALANCE OF PAYMENTS - HOW IT WORKS?

Leflair guarantees that all purchased products are genuine, brand new and not defective. The products you receive must not be damaged, work well and match with product's description on our website.

The return and refund policy described in this Terms and Conditions is an addition to the policy described in the Return and Refund Policy. For more information, please visit Return and Refund Policy on our website.

In case the product you receive does not meet our commitment, you will have up to 15 days to return products based on table below.

The returned item will be sent to Leflair for quality checking (QC). Leflair will refund the paid price of the returned item if it meets our Return terms and condition. If item purchased is faulty (product is damaged or defective), Leflair will cover all shipping fees for returns regardless of the refund method (card or bank transfer);

If you have prepaid your order via credit / debit / ATM card payment methods, you will receive your refund within 5 to 15 working days for local debit card and up to 30 days for credit card, depending on the refund method and the issuing bank.

In case of refund by bank transfer, the transaction will be processed within 5-7 working days. In case of refund directly to your Leflair account, the transaction will be processed within 24 hours after the items is received back from you.

Terms and conditions applied:

Valid return product must meet all these requirements:

- Products must be returned together with the Return Merchandise Authorization form and Leflair invoice or receipt.

- Products must have no sign of use or repair, full box, full accessories, client manual, stamps and/ or warranty cards and gifts (if any).

- Return windows are not more than 7 days (return due to convenience reasons) and 15 days (return due to defect reasons) count from delivery day. The countdown starts from the date you received the item (recorded on the system) to the date you contact us for return request.

- Return reason need to be substantial and meet terms & conditions

- Products are not under a specific return and refunds policy of some brands/ vendors/ specific classes.

- If the returned product does not fulfill all return requirements, Leflair will reship it to the customer.

Additional Information:
  • Late return:
  • We can accept a returnable item for up to 15 days from the date you initially got it. Sadly, things received after this period can't be accepted, and your item will come back to you. In the event that we get the same late return item a second time, we will keep your item and won't have the capacity to issue credit or disc

  • No exchange:
  • We endeavor to convey all that you require for an existence of style at Member-only prices each day. Our Boutiques open just for a brief time and afterward close. In view of this, we can't process trades. In the event that you are not satisfied with the item , you may return it for a refund to your own type of payment.

  • Wrong, damaged or defective items:
  • Our Members are at the heart of what we do, and we trust the product you get is precisely what you needed. In the event that you believe that an item was dispatched in blunder from Leflair, or if that it arrives imperfect or damaged in transit, we will offer assistance within 24 hours from delivery date.   • Final Sale:
  • We let you know when a thing is a Final Sale by taking note of it in item's bulleted description, furthermore on your packing slip. Final Sale product can't be returned.

  • Others:
  • In case a return order arrives in the warehouse for over 7 days without the Leflair team being able to you for the refund method, Leflair reserves the right to deduct a service fee on the refund to you at the time of the refund.

  • Fulfillment by Sellers ("Direct Delivery"):
  • Sellers directly process your order and are responsible for their goods.

    CONTENT ACCURACY

    At Leflair, we always try our best to ensure that the website content is updated and accurate. However, we may have some typographical errors, pricing errors or other inaccuracies that were not spotted by our teams. In that case, do not hesitate to let us know so we can fix it immediately.

    In order to enhance our service, we are open to any feedback you may have regarding the content of our pages to improve the Site and earn your satisfaction to experience our Site.

    Moreover, all intellectual property and copyrights infringement even if we make the registration or not yet, all contents and designs, graphics, software, images, sounds, software programing, source code and basic software are our own assets.     INDEMNIFICATION - WE PROTECT OURSELVES IF THEY MIS-USE OUR SERVICE

    When choosing our services, you agree to indemnify and protect Leflair from any claims, damages, losses, liabilities, and all costs and expenses of defense by a third party that arises in connection with your use or misuse of the Services or your breach of the terms and conditions.

    If you have any violation of any law or the rights of a third party, you have to agree to cooperate as fully as reasonably required in the defense of any claim. We will also have the right to protect ourselves if any party misuses our service.

    INTERNATIONAL USE - AT THEIR OWN RISK IF WISH TO PURCHASE FROM ABROAD SOMEHOW

    We're delighted you are interested in Leflair even from abroad! Let us get in touch with you to figure the best way to deliver to your doorstep.

    If you choose to internationally ship the item(s) you purchased using our services, please note the following:

    • Leflair delivers items only to locations within Vietnam
    • You are responsible for exporting the item from Vietnam and for completing all Vietnam export clearance responsibilities.
    • You are also responsible for making sure the item is lawfully imported into the destination country.
    • You are responsible for any import taxes, customs duties or fees.
    • Leflair must not be listed on any import or export documents, such as invoices, packing lists, import or export declarations documents, etc.
    • Leflair is not responsible for any damage, loss or defect that occurs after the item is delivered to the address in Vietnam as you provided us. For example, Leflair would not be able to issue a refund or account credit for items that are damaged or lost after our delivery to the address in Vietnam as designated by you.
    • You should contact your local customs office for additional information. Please note that any customs clearance process can cause delays beyond Leflair's original delivery time frames.
    • Eligible items purchased from Leflair and exported by you may be returned. Please note that all Leflair return policies are applied for domestic Vietnam shipments only. You are responsible for all costs associated with returning the item to Vietnam. International orders may be returned via your preferred method of shipping. Please know that by returning an item; you become the exporter and importer of the shipment. Leflair is also not responsible for damage, defect or loss that occurs to returns in transit to our warehouse.
    • Manufacturer's' warranties on any item may not be valid and manufacturing services may not be available. Items may not conform to the destination country's requirements or standards (including electrical standards or voltage requirements). Also, any accompanying documents such as product manuals, safety warnings, and instructions, may not be in the language of the destination country. You have to control it and be a charge of these procedures.

    RISK OF LOSS - ONCE HANDED OVER THE CARRIER, AND DELIVERED TO ADDRESS, CUSTOMER LIABLE

    If your parcel lost on shipping process, we will send you a replacement for the balance without any additional purchase. In cases of your order has been delivered by the carrier and you signed to get it, we will not take responsibility for any risk of loss.

    AFFILIATES - WE'RE NOT RESPONSIBLE FOR OUR REPRESENTATION BY OTHERS WITHOUT CONTRACT

    Leflair does not take responsibility for any representation by others without a contract. By the way, we're not affiliated with others for selling or advertising our products without negotiation via contract. If you use any service through unauthorized sellers, we are not in charge of any losses.

    TERMINATION AND FRAUD - OUR RIGHT OF CUSTOMER ATTEMPTS

    If we recognize any fake information, we will block your account immediately or apply other solutions as regulations of Vietnamese law. All your process is subject to verification. We reserve the right to void activities obtained fraudulently or used in a manner not in conformance with these terms and conditions. We reserve the right to cancel, delay, refuse to ship, or recall from the shipper any order if fraud is suspected. In the event your membership or account are terminated, the representations and warranties, indemnities, and limitations of liabilities set forth herein will survive termination.

    ARBITRATION & GOVERNING LAW - HOW WE SOLVE CONFLICTS

    Leflair will try to make our efforts to resolve any conflicts you may found. In cases of these efforts fail, please note that all claims, disputes arising out of or relating to your use of our services, these Terms and conditions, the purchase, sale and/or redemption of any merchandise and/or Vouchers, or the content, display or disclosure of any information on or in connection with the services or any claims are subject to binding arbitration. All of claims based on contract, tort (including intentional tort), fraud, agency, your or our negligence, statutory or regulatory provisions, or any other sources of law; Claims made as counterclaims, cross-claims, third-party claims, interpleaders or otherwise; and Claims made independently or with other claims. We both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

    All of claims will be resolved by the way of negotiation, conciliation, arbitration and/or the court under Consumer Protection Law - Chapter 4 about Dispute Resolution between consumers, organizations and individuals trading in goods and services.

    These terms and conditions (together with the Privacy Policy) and any Claims shall be governed by Vietnamese Laws, without regard to its conflict of laws principles. If any dispute arises from these, you can send a complaint to the court in Vietnam to address.

    MODIFICATIONS - LAST UPDATE, FUTURE UPDATES

    Here above are all of our terms and conditions, please read it carefully and contact with us for any further information. This is our last update and applied for any time when you use our services.

    For any update of these terms & conditions, visit our website and check it when receiving our notifications. We will notify you in advance by sending you an email to the last e-mail address you provided to us and by posting notice of the changes to our websites. Any changes will be effective at notified date and the changes will not apply for services prior to the effective date of the changes. If you do not accept the changes, you should not remain your account of membership before the effective date of the changes. If any change is found invalid, void or for any reason unenforceable, it will not apply for any remaining changes or conditions.
